ANNEX 1 - MANDATORY CONDITIONS
1 Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
2 No supply of alcohol may be made under this licence
a. At a time when there is no designated premises supervisor in respect of it or,
b. At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
3 The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
4 In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-
(a)games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i)drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii)drink as much alcohol as possible (whether within a time limit or otherwise);
(b)provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c)provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d)selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e)dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
5 The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
6 (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-
(a)a holographic mark, or
(b)an ultraviolet feature.
7 The responsible person must ensure that-
(a)where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i)beer or cider: ½ pint;
(ii)gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii)still wine in a glass: 125 ml;
(b)these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and
(c)where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.
8 A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
9 For the purposes of the condition set out in paragraph 8 -
(a)“duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(6);
(b)“permitted price” is the price found by applying the formula-
P=D+(D x V)
where-
(i) P is the permitted price,
(ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-
(i) the holder of the premises licence,
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994(7).
10 Where the permitted price given by Paragraph (b) of paragraph 9 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
11(1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 9 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The Prevention of Crime and Disorder
1. A text/pager/radio will be used to keep in contact with the premises providing licensable activities on the park.
2. Such text /pager/radio shall be kept in good working order and shall be monitored by a responsible member of staff.
3. Other than in the external area edged red on the proposed plans 4538-PH-130 A and 4538-PH-131 A from 18.00 hours one door supervisor shall be on duty for every 500 customers of part thereof.
4. A register of door staff will be maintained indicating the number of door staff on duty, their identity and the times they were on duty.
5. No person who is drunk and disorderly will be allowed access to the premises.
6. No person who is subject of a court banning order will be allowed in the premises provided the details of such person have been provided to the premises by the police.
7. Door supervisors will carry with them proof of their registration with the SIA and shall wear their name badges at all times.
8. No customer will be allowed to bring alcohol in open or sealed bottles on to the premises with the exception of the external area edged in red on plans 4538-PH-130 A and 4538-PH-131 A.
9. Tables will be cleared of all empty bottles and glasses on a regular basis.
10. A CCTV system will be installed internally at the premises and be in operation at all times the premises are open.
11. There will be sufficient cameras installed internally to cover all areas to which the public have access, with the exception of the toilet areas. All entry and exit points are to be covered and must provide a clear head and shoulders view.
12. The CCTV system will be of a standard capable of providing images of evidential quality and capable of facial recognition in all lighting conditions.
13. The CCTV system will have a facility to record the images from all cameras and these images will be retained for a minimum period of 28 days.
14. The CCTV system will include a facility whereby the correct date and time are included within the images recorded.
15. The CCTV system will have a facility whereby images can be downloaded onto some form of removable media. It is the responsibility of the premises licence holder to provide the removable media and that should removable media be seized, it is the responsibility of the premises to ensure that there are additional formats of removable media available.
16. Images from the CCTV system will be made available to Police or Local Authority officers on demand.
17. At least one member of staff trained in the use of the CCTV system and capable of providing the recorded images from the CCTV system will be available at all times the premises are open.
18. The Designated Premises Supervisor must ensure weekly checks of the operation of the CCTV system are. This check must include the operation of the cameras, the recording facilities, the facilities for providing footage and the accuracy of the time & date. A written record of these checks must be kept, including a signature of the person carrying out the check. This written record must be kept on the premises at all times and made available to a representative of any responsible authority on request.
19. PRIOR to being permitted to undertake the sale of alcohol all staff without a personal licence, including any unpaid members of staff, family members and casual persons who may be involved in the sale of alcohol at the premises, will be trained in their responsibilities under the Licensing Act 2003 and any subsequent amendments to that Act - in particular they will receive training with regard to the service of alcohol to persons who are drunk. Training will also include the premises age verification policy Challenge 25.
20. Refresher training in relation to the initial training at 2) above will be undertaken by all members of staff involved in the sale of alcohol every six months.
21. Records of the initial training received and subsequent refresher training will be maintained and will be produced to Police or Local Authority officers on request.
22. Incident and Refusals Book- an incident and refusals book (with the pages numbered sequentially) must be kept on the premises and be made available for inspection by responsible authorities. The incident and refusal book must be used to record the following:
a) Any incident of violence or disorder on or immediately outside the premises.
b) Any incident involving drugs (supply/possession/influence) on the premises.
c) Any other crime or criminal activity on the premises.
d) Any refusal to serve alcohol to persons who are drunk.
e) Any refusal to serve alcohol to under 18’s or anyone who appears under 18.
f) Any call for police assistance to the premises.
g) Any ejection from the premises.
h) Any first aid/other care given to a customer.
23. The incident and refusals book record will be made available for inspection by North Wales Police or Local Authority officers on request.
24. The premises licence holder shall accept the following forms of ID as valid proof of age and identity:
a. A picture driving licence,
b. Passport
c. PASS accredited proof of age card
d. Any other form of identification as approved or prescribed by the Secretary of State as a mandatory condition
25. If required crime prevention notices will be displayed in the premises warning customers of any prevalent crime that may affect them.
26. All staff who work behind the bar will be fully trained to ensure that no person who is drunk or disorderly or who appears to be under the age of 18 is served intoxicating liquor.
Public Safety
1. The capacity for Dunes is 980, Carousel 580 and The Mash and Barrel 690
2. An adequate supply of free drinking water shall be provided for all customers.
3. A qualified medical first aider shall be present throughout any sporting entertainment involving wrestling, judo, karate or sport of a similar nature. There will not be any boxing.
4. Where a ring is used it will be constructed by a competent person and shall be inspected by a competent authority before use and any material used to form the skirt of the ring shall be flame retardant.
5. Members of the public will not occupy any seat which is closer than 2.5 meters to the ring.
6. Polycarbonate or plastic glassware will be used at the bars serving alcohol in the external area edged red on drawig numbers 4538-PH-130 A and 4538-PH-130 A.
Prevention of Public Nuisance
1. Doors and windows will be kept closed where necessary.
2. The playing of recorded music in any outside area shall not continue beyond 23.00hours.
3. The external area as indicated and edged red on plans 4538-PH-130 A and 4538-PH-131 A to be in use for the sale of alcohol from 11.00 until 23.00 on Monday to Sundays.
The Protection of Children from Harm
1. The age verfication policy that the premises will operate will be Challenge 25.
2. The premises licence holder shall accept the following forms of ID as valid proof of age and identity:
a. A picture driving licence,
b. Passport
c. PASS accredited proof of age card
d. Any other form of identification as approved or prescribed by the Secretary of State as a mandatory condition
3. No performance of nudity or striptease shall take place at the premises.
4. Where performances are presented especially for unaccompanied children there shall be at least one attendant for every 50 children or part thereof.
5. The premises licence holder will carry out appropriate checks with the Disclosure and Barring Service in accordance with legal requirements upon it, from time to time, for any members of staff whose job description means, that they are in regular contact with persons under the age of 18.
